Should Louboutins red sole trademark be protected?

Today, An American judge denied Christian Louboutins requests to stop YSL’s production of their red soled products. YSL says that Louboutin has no right to monopolize the colour to be used on soles of shoes, although Christian Louboutin claims he was awarded an official trademark for the soles. The judge said “Because in the fashion industry color serves ornamental and aesthetic functions vital to robust competition, the court finds that Louboutin is unlikely to be able to prove that its red outsole brand is entitled to trademark protection.”
Christian Louboutin should with it’s ‘trademark’ soles.
What do you think? Should the red soles be exclusive to Christian Louboutin? Is it their trademark to be untouched? Or is it just a colour, and it shouldn’t be monopolized?
